Hospital malpractice occurs when a healthcare provider such as a doctor, nurse, surgeon or specialist makes a mistake that harms a patient. The hospital itself can be found negligent if it fails to provides its staff with adequate training, is understaffed, or fails to maintain a safe environment for its patients.
Hospital malpractice can occur in a variety of ways, including failing to treat an emergency situation in a timely manner, failing to provide adequate treatment, or misdiagnosing a critical injury or illness.
An example of a recent medical malpractice claim against Stamford Hospital involves a Norwalk couple who sued Stamford Hospital and a physician for their baby’s severe injuries after a cesarean section. According to NBC Connecticut, the couple won a $58 million award, the largest medical malpractice judgment ever received in the state of Connecticut.
The jury made its decision in May. According to the lawsuit, the baby, now an 8-year-old boy, was brain damaged during delivery. He has cerebral palsy and is unable to sit up, stand, walk, speak, or feed himself. The child also has seizures.
According to NBC Connecticut, the couple sued Dr. Richard Viscarello of Maternal-Fetal Care and Stamford Hospital, claiming the doctor delayed performing the C-section, and that the delay and other actions caused the cerebral palsy. The couple said Viscarello did not properly care for the baby before he was born and failed to be assisted by the necessary experts when the baby was delivered, including a certified anesthesiologist or an expert in inserting an endotracheal tube.
The lawsuit also claimed that the doctor and his staff failed to determine the baby’s position in the mother before being delivered. In addition, the couple said they were not warned about the risks, complications and hazards of the delivery.
If you suspect that you may be a victim of medical malpractice, there are some steps you will need to take to protect your legal rights. Right now, some of the most important steps you can take include:
While it can be difficult to trust any doctor if you have concerns about medical malpractice, you need to make sure you receive the care you need. At this point, you should see a different doctor at a different facility. If you aren’t sure where to go, we can recommend several specialists in the Stamford area who have been treating our clients for decades.
Collect any records you received from the health care provider that you suspect provided substandard care. These records include x-ray images, scans, test results, prescriptions, and anything else you may have. Compile any bills, statements of benefits, and receipts you have as well. It is okay if you don’t have everything, but anything you do have will be helpful for those who are assessing your claim.
In addition to any records you have pertaining to your medical care, it will also be important for you to have documentation of the effects of the suspected malpractice. This includes documentation of any days you miss from work, any additional expenses you incur, your daily pain levels, and any other ways your medical condition impacts your day-to-day life.
Although it can be difficult to take your mind off of the fact that your health care provider made a mistake, at this point, you need to focus on your recovery. Be sure to follow through with your new provider’s treatment recommendations, rest and rehabilitate as warranted, and do everything you can to help yourself recover as fully and quickly as possible.
To file a claim, you will need to hire an experienced Stamford medical malpractice lawyer to represent you. When you choose Berkowitz Hanna, our team of experienced lawyers will thoroughly examine your claim, accurately calculate your losses (current and future), and work to recover just compensation on your behalf. If we are able to obtain a settlement offer from your health care provider’s insurance company, we will discuss the offer with you in detail, and we will help you make informed decisions about how and when to resolve your claim.
If you are a victim of medical malpractice, the costs of your provider’s mistake could far exceed the costs of treatment and recovery. Loss of income, pain and suffering, and emotional trauma are all common among medical malpractice victims. In addition, your future losses could far exceed the losses you have incurred to date, and you will need to work with a team of experienced Stamford medical malpractice lawyers to make sure you receive the full compensation you deserve.
