Dan Brill has been awarded $900,000.00 at a binding arbitration against Danbury Hospital on behalf of a 75 year old client. Our client, an insurance benefits consultant, was setting up for a presentation early in the morning at the defendant hospital when the lighting in the room suddenly went dark. Our client subsequently tripped over a computer cord in the darkened room causing her to violently fall and strike her right side, including her head. Our client sustained a fractured hip and traumatic brain injury which have rendered her permanently disabled. According to Brill “the sensors in the room that controlled the lighting were clearly defective and in violation of the building code. Our client has suffered so much because of this accident.” The arbitrator found the hospital 55% at fault and the plaintiff’s comparative negligence was 45%. The net arbitration award for the plaintiff was $495,000.00.
