The Berkowitz Law Firm LLC Reflects on Ohio Medical Malpractice Suit Involving Birth Injury

Written by Berkowitz

birth injuriesDepending upon the circumstances, many birth injuries in newborns can be prevented by following proper medical procedures. The Berkowitz and Hanna LLC knows firsthand from representing medical malpractice lawsuits —including those involving birth injuries– that these cases can severely impact both the child (with lifelong medical care) and his/her parents (with emotional suffering and loss of income due to childcare).

A recent case reported by the Ohio news station WFMJ involved a couple being awarded $28.7 million in damages after their son was born with cerebral palsy in 2010, the result of oxygen deprivation during his birth. A settlement was reached, and included $24.9 million for future care costs, $2.9 million for lost earning capacity and $500,000 each to the boy’s parents, Jennifer and Matthew Wolcott, for noneconomic loss.
