Russ Berkowitz has settled a wrongful death medical malpractice case on behalf of the estate of a 58 year old client who was overdosed with pain medication during a routine hospital emergency room visit for a severe headache. Following multiple doses of pain medication, our client sustained a decrease in his respiratory rate while alone in his room.
Unfortunately, because he was not receiving any telemetry monitoring, our client’s respiratory depression progressed to ventricular tachycardia, and ultimately he sustained a cardiac arrest. Because he had been left alone in his room for over 40 minutes, by the time our client was discovered, he was already brain-dead and died two days later.
