Russ Berkowitz Settles GIST Cancer Misdiagnosis Case

Russ Berkowitz has settled a medical malpractice case on behalf of a client whose cancer was misdiagnosed by the defendant hospital. Our client was diagnosed in March of 2019 with a gastrointestinal stromal mass (GIST) and was advised by his oncologist that his tumor was slow growing which didn’t require him to undergo any adjuvant treatment following his tumor resection.

In October of 2020, a routine CT Scan revealed a dramatic recurrence of our client’s cancer that had unexpectedly progressed to metastatic Stage 4 and had spread into his pelvis and abdomen. Our client visited a hospital in NYC for a second opinion and was advised by said hospital that the pathologist at the defendant hospital had misread our client’s pathology slides back in March of 2019 and that our client should have received chemotherapy which would have significantly increased life expectancy. Our client now has 6-12 months to live.

“It’s hard to believe that the pathologist at the defendant hospital could be so careless in his interpretation of our client’s pathology slides. This is such a sad outcome for such nice person and his family.”
