Russ Berkowitz has filed a lawsuit against Hartford Hospital in Hartford Superior Court on behalf of a baby who died one day following her birth as a result of negligent care provided to her mother two days earlier when she presented to the defendant hospital complaining of decreased fetal movement but was discharged by the hospital’s obstetrical team a few hours later.

The lawsuit states that the next day, our client’s mother presented to the hospital again and was rushed into the operating room for an emergency c-section because it was determined that her baby was in fetal distress. Immediately after delivery, our client stopped breathing because she had sustained hypoxia ischemic encephalopathy (brain damage due to lack of oxygen) prior to being readmitted to the hospital. Unfortunately, our client’s condition further deteriorated, her organs shut down, and she died the next day.

According to Attorney Berkowitz “our client should have never been discharged from the hospital the day before her delivery since her fetal monitor tracing results were not reassuring and she was at a heightened risk of developing sustained hypoxia if discharged home unmonitored.”

“With proper care, our client would be alive today. This is a very sad ending.”
