Federal Court Hears Motion on Destruction of Transvaginal Mesh Evidence

A group of attorneys filed a motion on Dec. 2 against Ethicon and its parent company Johnson & Johnson alleging that the company lost or destroyed tens of thousands (maybe more) documents that could be important for transvaginal mesh litigation.

The federal court that is overseeing the transvaginal mesh multidistrict litigation heard arguments related to the missing documents on Jan. 23. The attorneys who filed the motion are asking that the company be responsible for plaintiffs’ attorney’s fees and other costs. They are also asking for default judgments in favor of the moving plaintiffs and that the court issues a “spoliation instruction” to the jury at each upcoming bellwether trial.

Ethicon is one of several companies that is being sued for alleged injuries involving transvaginal mesh products. According to documents, it is the only company that is not involved in mass settlement talks.

Plaintiffs are alleging injuries such as severe pain and discomfort, hemorrhaging and bowel and bladder perforations. Injuries are arising from complications such as mesh erosion.
