A woman filed a wrongful death lawsuit against Dr. Michael Waldman, a radiologist who previously practiced at New Milford Hospital on behalf of her husband who died from a perforated spleen.
Co-defendants in the medical malpractice case include New Milford Hospital and Radiological Associates of New Milford.
Diane D’Amato filed the lawsuit on behalf of Thomas D’Amato, 74, who died at Danbury Hospital three days after Dr. Waldman performed a radiological procedure on him at New Milford Hospital. Medical examiners found that Dr. Waldman was aware that he perforated Thomas D’Amato’s spleen during the procedure, but failed to tell him and sent him home unaware.
According to Department of Public Health documents, Dr. Waldman failed to properly monitor the patient even though he was aware that he perforated the spleen.
“I filed this suit basically because I felt like the reprimand from the Medical Examining Board was not sufficient,” Diane D’Amato said May 25. “I thought the board should have taken a stronger action, and this is the only avenue of action left to me.”
Diane D’Amato reportedly said she filed the lawsuit only after discovering that Dr. Waldman knew what he did and didn’t tell anyone about it. She filed the medical malpractice/wrongful death suit on May 18 in Litchfield Superior Court.
Waldman resigned in med-February, according to reports.
