The Berkowitz Law Firm LLC Comments On $10M Walmart Settlement Awarded To Children Of Comedian Killed In Tracy Morgan Car Crash

Although nothing can adequately compensate for the emotional loss of a loved one, financial burdens and stress can certainly be reduced or alleviated with a reasonably substantial settlement—as in the case of Jamel McNair (26) and Denita McNair (19), who received a $10M settlement from Walmart, for the crash that killed their father, James McNair.

Several comedians, including James McNair and 30 Rock actor Tracy Morgan, were driving northbound on the New Jersey Turnpike after a comedy gig at 1:00 AM on June 7, 2014, when a Walmart US tractor-trailer crashed into the back of their Mercedes-Benz limousine van. Morgan, critically injured, and his assistant were airlifted to a nearby hospital. McNair was pronounced dead at the scene. The truck driver, Kevin Roper, was charged with one count of death by auto and four counts of assault by auto – but has not yet been indicted. Walmart has been sued by the families of all the crash victims. The company recently settled the case brought by McNair’s family. Walmart stated that “We are glad to have reached an agreement” and “worked closely with his (McNair’s) family to ensure their well-being.”

Notes Berkowitz and Hanna LLC, the McNair children will be putting part of their settlement payment in annuities that will pay them monthly stipends for the rest of their lives.
